At HeatMap, Inc. we take your privacy very seriously. Access to your data is limited to the website owners and is collected in a way to protect you and your information. Our opt-out options allow you to prevent data tracking when you navigate on:

  • HeatMap, Inc. own and operated web sites (heatmap.com and heatmap.it)
  • HeatMap, Inc. clients' web sites – sites on which HeatMap, Inc. collects statistical data

We respect the "Do Not Track" setting of your browser. All major Internet browsers now let you specify "Do Not Track" that sends a signal to the websites you visit, asking to not collect any data about your browsing activity. Learn more about "Do Not Track" and how to activate it.

If you haven't set "Do Not Track" in your browser, you can still opt-out by accepting our "opt-out cookie", signaling to our servers that you opted-out for all subsequent visits to sites measured by HeatMap, Inc. This opt-out preference will only be taken into account for the browser on which the "opt-out cookie" has been placed.

If you do not accept this "opt-out cookie", or if you later delete it, our servers will not be able to detect your opt-out preference, and will therefore continue to collect data about your browsing activity.

This Privacy Policy forms part of our Terms and Conditions and describes our privacy practices. Our Privacy Policy explains the details of how HeatMap, Inc. collects information from your browser and device when you access website pages. We also explain the choices we offer, making sure you are in control of your personal information at all times. By visiting our website or by visiting one of our clients' websites (which will provide you with notice of its use of HeatMap, Inc. and this policy) or by signing up via our website, you acknowledge that you accept and consent to our privacy practices as outlined in this policy.

Who is HeatMap, Inc.

HeatMap, Inc. offers a SaaS tool for analyzing and representing the online behavior of website visitors.
By combining both analytics tools and visual heatmap representations, HeatMap, Inc. helps its clients understand how to improve their site's user experience, its performance and increase conversions.

How HeatMap, Inc. collects information

We provide our clients with a tracking code, which will be used to collect your information and send it to our servers based in Europe, in Canada and in the United States. When you visit a website which makes use of our product, this tracking code will automatically collect the information based on your activity and store it in our servers, for our client's analysis. Information will also be collected from cookies which will be placed on your computer or device by the website. We do not knowingly or intentionally collect any personal information from minors.

What information we collect

We collect information in the following ways:

  • When signing up to use HeatMap, Inc. analytics tools, we may ask you to provide us with your name, email address and details about your organization. We will only use this information to provide you with the service that you signed up for and where we would like to use the contact details you have provided us with for any other purpose we will inform you and obtain your consent before proceeding. For info on how to deactivate your account and/or unsubscribe from receiving content or offers, kindly contact us here.
  • When navigating through our site and on each of our clients' site pages, we automatically collect information without your knowledge, as well as information on your device or computer (such as cookies). The sole purpose of collecting your navigation information is to improve your experience when using our clients' sites and web services.

Through the tracking code embedded by our clients on their website, the information we collect includes:

  • mouse and touch activity (but no keyboard activity)
  • device screen size
  • geographic location (country only)
  • pages visited
  • date and time when website pages were accessed

How we secure data

We have implemented various measures to ensure that the information is adequately protected against unauthorised access, use, disclosure and destruction. Please keep in mind that risk can never be eliminated but can be significantly reduced. All measures which we have taken significantly reduce the risk. We will not be held liable by any third party in the event of unauthorized access, use and/or disclosure of information. Measures include:

  • Access to the information stored within our servers is restricted to a limited number of HeatMap, Inc. employees and to users designated on our client's accounts. OVH SAS can access the information only in specific and limited circumstances. Our employees, our clients and these third parties are bound by confidentiality.
  • Our servers are protected by a) firewalls establishing a barrier between our trusted, secure internal network and the internet and b) IP restrictions, limiting access to whitelisted IPs.
  • Each client may only access information pertaining to the sites it is tracking and to the users browsing on its website pages.
  • We use HTTPS for our site pages and services providing secure transfer of data to prevent wiretapping and man-in-the-middle attacks.
  • We will review our information collection and processing practices periodically and we will review and amend this privacy policy accordingly.

Cookies

Our websites (heatmap.com and heatmap.it) use cookies to collect non-personal information including standard internet log information and details of your browsing activity upon visiting our website pages. We do this to provide you with a better experience, identify preferences, diagnose technical problems, analyse trends and to improve our website.
Cookies are small data files transferred onto computers or devices by websites for record-keeping purposes and to enhance functionality on the website.
We may also use cookies to record login details on your device or computer. This helps to determine whether a particular device previously visited our website so that the login details would not have to be re-entered each time you visit our website.
Most browsers allow you to choose whether to accept cookies or not. If you do not wish to have cookies placed on your computer, please set your browser preferences to reject all cookies, before accessing HeatMap, Inc. or other websites owned by our clients that may use HeatMap, Inc.

GDPR Compliance


HeatMap is compliant with the General Data Protection Regulation (GDPR).

Definitions

  • Personal data: any information relating to an identified or identifiable real person. An identifiable real person is defined as any real person who can be directly or indirectly identified.
  • Processing: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collecting, recording, transmission, storage, conservation, extracting, consultation, use, disclosure by transmission and so on.
  • Controller: the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
  • Processor: the natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
  • Data request: a request made by a natural or legal person regarding data collection/processing, or deletion under the "right to be forgotten" clause

HeatMap as a processor

Customers who sign up for HeatMap's product and install the relevant tracking code in their websites act as controllers and agree to transmit data about their visitors to HeatMap per our DPA, while HeatMap commits to its responsibilities as a processor in terms of security, privacy and data protection:

  • As explained on this page in the What information we collect, HeatMap does not intend to capture personal data, and all stored data is anonymized and aggregated by design, and as been so since the product's inception.
  • As controllers, HeatMap's customers may receive a request for data request from one of their visitors, but HeatMap will not be able to extract/delete data from our servers since, by design, HeatMap cannot identify the visitors.
  • In this context, visitors should direct their data request to the website operators and/or use the opt-out options listed at the top of this page.
  • HeatMap also does its best effort to keep all data originating from the EU within its EU datacenters, even though this data is not identifiable.

HeatMap's customers as controllers

As a website operator, you may fall under the GDPR as a data controller, and as a processor, HeatMap is fully committed to help you in your compliance efforts. Besides all your duties as a data controller, you may want to:

  • Expose on your site(s) that you use HeatMap as an analytics product
  • Link to our privacy policy (https://heatmap.com/privacy). We support DNT and our own opt-out cookie that applies to all sites using HeatMap.
  • Make sure you do not expose personally identifiable information (for instance in your URLs) as HeatMap is unaware that part of the transmitted data is personal data. If this happens, it is your duty to fix your implementation and notify HeatMap for removal of those URLs.

If you use our conversion heatmap, HeatMap will be setting a cookie on your domain (you define the name of the cookie), which does not override DNT or the opt-out cookie. This cookie only stores a non-identifiable unique id that is not shared with other customers using HeatMap (no cross-site tracking).

HeatMap as a controller

HeatMap is a data controller for its own websites (heatmap.com and heatmap.it), and as such:

  • HeatMap limits the data it collects to the minimum, and only uses the data it collects for the purpose for which it was collected. For instance, any cookie set is absolutely needed for the use of the service and is not used for external tracking (see Cookies section above).
  • HeatMap is committed to protect the data it collects (see How we secure data section above).
  • All unnecessary data is fully deleted from our live databases and backups within 90 days of the deletion.
  • Visitors should send data requests to support@heatmap.com.
